Diplomatic immunity is a form of legal immunity which generally makes diplomats immune from being arrested, searched or prosecuted under a country’s laws. Immunity granted to diplomats by the Vienna Convention on Diplomatic Relations of 1961 is a privilege given by independent states who allow diplomats from foreign states to enter their own territory. Its own representatives abroad are in a sense hostages who may on a basis of reciprocity suffer if it violates the rules of diplomatic immunity, or may be penalized even for minor restrictions regarding privileges or protocol. There was at the 1961 Vienna Conference no general underlying conflict of interest between opposing groups of States. Diplomatic immunity is a status granted to diplomatic personnel that exempts them from the laws of a foreign jurisdiction.
